Sean "Diddy" Combs' release date has been moved up to February 23, 2028, after multiple adjustments

Combs is participating in a drug-abuse rehabilitation program at FCI Fort Dix, which his attorneys requested for family proximity

His legal team continues to appeal his conviction and sentence, calling the punishment excessive and seeking acquittal or resentencing

Sean "Diddy" Combs is getting another reduction in his projected time behind bars.

According to the Federal Bureau of Prisons website, the music mogul is now scheduled to be released from federal custody on Feb. 23, 2028, marking the latest change to his anticipated release date.

The update continues a pattern of adjustments that have steadily moved Combs' projected release date forward. Earlier this year, the Federal Bureau of Prisons listed his release date as April 15, 2028. Before that, it was listed as April 25, 2028 and, previously, June 4, 2028.

While the Bureau of Prisons has not publicly explained the latest change, Combs has been participating in a drug-abuse rehabilitation program while incarcerated at FCI Fort Dix in New Jersey. His attorneys previously sought placement at the facility because of its treatment programs and proximity to family.

"In order to address drug abuse issues and to maximize family visitation and rehabilitative efforts, we request that the court strongly recommend to the Bureau of Prisons that Mr. Combs be placed at FCI Fort Dix," attorney Teny Geragos wrote in an October 2025 court filing.

The revised release date comes as Combs continues to challenge the conviction that sent him to prison.

The 56-year-old is serving a 50-month sentence after being convicted last summer on two counts of transportation to engage in prostitution following a federal trial in New York. Jurors acquitted him of more serious charges, including sex trafficking and racketeering conspiracy.

His attorneys formally appealed both his conviction and sentence last December, arguing that the sexual encounters at the center of the case were consensual and that the punishment imposed by the court was excessive.

In a March appellate filing, Combs' lawyers described his prison sentence as a "perversion of justice" and argued for his "immediate release and a judgment of acquittal or at least vacate and remand for resentencing."

Federal prosecutors have urged an appeals court to reject those arguments.

In court documents obtained by PEOPLE, prosecutors argued that Combs was a repeat offender and said the trial judge properly considered evidence presented during the proceedings when determining his sentence.

"According to Combs, the district court should have closed its eyes to how he carried out his Mann Act offenses and abused his victims — violently beating them, threatening them, lying to them and plying them with drugs," prosecutors wrote in the filing.

The appeal remains pending before the U.S. Court of Appeals for the Second Circuit, meaning that even as Combs' projected release date continues to move, his legal battle remains unresolved.

PEOPLE reached out to attorneys for Combs, but did not immediately hear back.
